Asset Protection and Generational Planning
At this FSB event, we have invited Chris Smith from Countrywide Legal Services to look at the sensitive subject of protecting your assets and business in the event of re-marriage, divorce or bankruptcy.

In particular Chris will cover:

1. How Can I Preserve My Business Assets For My Family?
Without appropriate Business Succession strategies –

Your Spouse/Partner and Children may not inherit your share of a business.
Business Partners may not be able to buy out the deceased’s share.
The Business may have to be sold and the proceeds become liable to Inheritance Tax.
Business Property Relief could be lost.
2. How Can I Protect Your Assets From Attack?
The assets you have created in life can be under threat from a number of areas –

Bloodline Planning: If you leave assets absolutely to your Children, they can be attacked in the future if the Children divorce/separate or go bankrupt.
Long Term Care costs: The Family Home can be forcibly sold to cover these costs and your liquid assets taken.
Inheritance Tax: The tax rate is currently 40% and can seriously deplete the assets you wish to pass on to the next generation.
3. How Can I Protect My Children’s Inheritance?
Without the correct Bloodline Planning –

Some or all of your Children’s or Grandchildren’s inheritance could be lost.
Assets not protected by a Trust face attack from
- Divorce/Separation settlements of future generations.
- Creditors or Bankruptcy claims.
- Further Inheritance Tax bills
Distributing assets absolutely to beneficiaries exposes these assets to risk.
4. What If Some Of My Assets Went To People I Didn’t Wish To Benefit?

If one of your Children’s marriage ends in Divorce, would you really want an ex in-law to walk away with 50% of the assets you left to your Child?
Should one or more of your Children get into financial difficulties, would you be happy that Creditors could potentially claim 100% of their legacy?
If your Spouse remarries and has more Children, would you want those issue to benefit equally from the legacy you left to Your Own Bloodline?
If your Spouse ends up in care, would you be happy that ALL of their savings and property could be lost to the costs of Long Term Care?
Inheritance Tax is charged at 40% on asset values over the Nil Rate Band (£325k), do you really want to make the Taxman one of your Principal Beneficiaries?
